Liquid Leisure Activity Agreement

At Liquid Leisure we take your health and safety seriously. We wish to highlight that any of the activities available can be potentially hazardous physical activities and that participation can lead to a risk of injury and even death.

As the responsible person, I can confirm that all parents and/or guardians of the group I have organised to participate in activities at Liquid Leisure have been informed of and understand all points of this activity agreement.

Additionally, that by this Activity Agreement/Waiver I confirm the participants are competent swimmers and are confident in deep open water, additionally, the participants have a reasonable level of fitness and ability and would be able to exit the water without assistance.

I the organiser of the participants, confirm as follows:
1. I understand and accept that in participating in activities at Liquid Leisure that there is an element of danger and risk of physical or emotional injury to both the participants and others and consequently the participants are to undertake to use Liquid Leisure’s equipment and facilities (the “Facilities”) and to conduct themselves while on Liquid Leisure’s premises, in a sensible and responsible manner and in compliance with all notices, instructions and directions as published or displayed from time to time and in compliance with any instruction given to the participants by an authorised person in Liquid Leisure’s control.

2. That the participants are in a good state of health and free from any injury, medical condition, disease or illness which may be aggravated by participating in activities at Liquid Leisure or which may make it unsuitable for the participants to take part in such activities. Additionally, the participants do not have any medical condition that may make the activities more dangerous or may increase any risk of injury to the participants or others or make more likely that the participants will be involved in an accident which could result in any form injury during the activity.

3. I acknowledge that the activities provided by Liquid Leisure are not available to pregnant women and that by accepting these terms I confirm that the participants are not pregnant.

4. I acknowledge that cosmetic body enhancements including but not limited to false nails, none removable jewellery and other surgical additions could cause injury to the participants of any activities. Liquid Leisure strongly advises any participants to remove these if possible before participating or not to participate, as Liquid Leisure will not be held accountable for any injury caused to the participants.

5. I acknowledge and agree that the participants are responsible for their own safety and the safety of others whilst participating in activities. I understand that the activities may be undertaken without direct supervision following safety instructions and agree that the participants will at all times wear any protective equipment provided by or required by Liquid Leisure to be worn and will ensure that the participants comply with all instructions given at any time during the activities by Liquid Leisure by any of its staff, media or signage. I further acknowledge and agree that the participants will wear buoyancy aids where required and will not remove this at any point whilst in the water.

6. I agree that the participants shall not participate in any activities provided by Liquid Leisure unless the participants have undertaken Liquid Leisure’s safety and induction procedures and processes in relation to the activities and confirm that the participants will comply with these at all times whilst on the premises from which the activities will be carried out.

7. I agree that the participants will only carry out moves and tricks that are within the participant’s skill and fitness levels and of which the participants are able to retain control of at all times. That the participants will also only use features that the participants have the ability to use within the participants skill and fitness levels. Moves and tricks and use of features are performed entirely at the participants own risk and I will not hold Liquid Leisure liable for any injury the participants may attain whilst participating in these activities. I acknowledge I and other participants are not ready to use features until I/they can at least perform the following manoeuvres and tricks:
a. Sitting and standing dock start
b. Frontside butterslide - hold for 5 seconds
c. 6x surface 180s in a row i.e. both ways
d. 6x connected heelside and toeside carves 2m wide of the cable in both normal stance and switch
e. Switch corners - 4 in a row
f. Toeside corners - 4 in a row
g. Ollie frontside 180 - 3 in a row and switch
h. Backside butterslide - hold for 5 seconds

8. I agree and promise to ensure the participants accept to be responsible for any and all risks existing and subsisting in the activities. I acknowledge that participation in the activities is voluntary and that the participants elect to participate despite of the risks and agrees to accept the consequences of so doing.

9. That the participants will not use Liquid Leisure’s facilities and activities whilst under the influence of any drugs or alcohol.

10. That I will fully indemnify Liquid Leisure, its agents and employees against any claim brought by a third party for loss, damage, injury or death which has been caused by any action or omission of mine or any act or omission of any participants of which I am the organiser of the participants whose supervision is wholly or partly my responsibility at the time of the relevant act or omission that would, if they had agreed to the same with full capacity to do so, amount to a breach of these Terms and Conditions or which amounts to negligence or a wilful act or omission.

11. That when accompanying a child or children under the age of 14 years, I will comply and ensure that the child or children are safe and looked after. I will be present on site at all times and will not leave them unattended.

12. I confirm and agree that the participants will comply with all age and height restrictions specified by Liquid Leisure from time to time. The participants acknowledge that if they do not comply with any age or height restrictions or any other requirements put in place by Liquid Leisure from time to time, they will not be able to participate in the activities and agree that they will promptly withdraw upon request by Liquid Leisure.

13. I acknowledge that nothing in these Terms and Conditions is intended to avoid liability, on the part of Liquid Leisure, for personal injury or death caused by the negligence of wilful act of its authorised person or agents.

14. I as organiser of any accompanying children give consent and agree to Liquid Leisure photographing and/or recordings myself and any accompanying children and to use any such photographs and/or recording solely and only for Liquid Leisure advertising and promotional purposes. Any accompanying minors and I hereby waive any right to inspect or approve the use of any such material and acknowledge and agree that the rights to use such material shall not require payment or compensation of any kind to be made by Liquid Leisure to myself and/or any accompanying children. I am fully aware that I must contact a manager of Liquid Leisure if I do not wish to be a part.

15. The participants consent and agree to the use by Liquid Leisure of CCTV monitoring for training, health and safety and security purposes.

16. Liquid Leisure consents to the participants and accompanying members of their group undertaking photography for their own non-commercial purposes only and for no other purpose whatsoever. However, the participants and accompanying members of their group are not to use any drone type equipment at Liquid Leisure, without seeking the correct permits, having the required training, licenses, and insurance, with supporting documentation being available, to operate the equipment, before seeking the approval of the senior management at Liquid Leisure.

17. The participants, parents and/or guardians acknowledge that Liquid Leisure is not and shall not be liable for any damage or loss to themselves, any third parties or property incurred whilst the participants are undertaking the activities or are on the premises of Liquid Leisure.

18. That participants may be asked for proof of I.D at any age. I must be able to produce documents if necessary. Failure to do so can result in being refused to partake in activities.

19. I confirm that I have read the above and adhere to the guidance set by the staff.

20. I confirm I am over the age of 18 years, signing for myself as the organiser of participants under the age of 18 years old.
